General terms and conditions - promotion

GENERAL

  1. These terms and conditions apply to the promotion (Winactie Bar-le-Duc 2024) and can be found on the promotion website bar-le-duc.nl/win.
  2. This promotion with purchase obligation is organised by Bar-le-Duc, office at Reactorweg 69 in Utrecht, as part of United Soft Drinks B.V. and serves to promote the products of Bar-le-Duc.
  3. The promotion starts on Monday 15 April 2024 and ends on Sunday 21 July 2024 – 23:59.
  4. During the promotion, a maximum of 2 million bottles with promotion codes will be available for distribution to participants, with a sell-out guarantee. Bar-le-Duc cannot be held responsible for the early sale of bottles.
  5. Participation in the promotion is free.
  6. By participating in the promotion, the participant is deemed to be aware of the terms and conditions of the promotion and agrees to the terms and conditions of the promotion, the privacy statement and the disclaimer as published on the promotion website.
  7. Bar-le-Duc reserves the right to contact all participants once with a commercial offer separate from the prize draw.

PARTICIPATION AND ELIGIBILITY

  1. Participation in this promotion is open to all persons over the age of 18 residing in the Netherlands.
  2. Employees of Bar-le-Duc or (legal) entities affiliated with Bar-le-Duc and their family members residing in the Netherlands, as well as persons directly involved in this promotion (such as advertising agencies and United Soft Drinks employees) and their family members residing in the Netherlands, are excluded from participation in this promotion.
  3. Participation is personal and participants must be able to provide proof of their identity and age at the request of Bar-le-Duc in order to verify their identity and that they meet the conditions for participation.
  4. To participate, participants must have an Internet connection.

GENERAL TERMS AND CONDITIONS

  1. Participants shall not be entitled to any rights and/or compensation for participating in this promotion other than as expressly set forth in these terms and conditions.
  2. Bar-le-Duc reserves the right to disqualify, forfeit any prize and refuse to award any prize to any entrant who fails to comply with these terms and conditions or otherwise enters or participates in the promotion in a fraudulent manner. Anyone who participates in this promotion in an organised manner for the purpose of increasing the chances of winning is excluded from participation.
  3. Participants may not submit viruses or other malicious software to the promotion website.

HOW TO ENTER

  1. With the purchase of one (1) promotional product (Bar-le-Duc still 1.5l PET bottle, Bar-le-Duc carbonated 1. 5l PET bottle, Bar-le-Duc carbonated lemon 1.5l bottle with cap, Bar-le-Duc non-carbonated 1l bottle with cap, Bar-le-Duc carbonated 1l bottle with cap, Bar-le-Duc non-carbonated 0.5l bottle with cap) from Bar-le-Duc in all participating supermarkets, consumers will receive one (1) promotional code.
  2. To participate in the promotion and have a chance to win the prizes, consumers must activate the promotion code they receive and register via the promotion website.
  3. The unique code found on the inside of the cap is required to participate in the promotion. This code can only be activated once.
  4. All entries and/or registrations must be received by 23:59 on Sunday 21st July 2023 at the latest.
  5. Only fully and correctly completed entry forms will be considered valid.
  6. There is no limit to the number of times a consumer may enter. However, once a prize has been won through participation, it is not possible to enter again for another prize.
  7. The participant must retain the original bottle & cap and proof of purchase of the promotional product from the participating supermarket. This may be requested by the organiser at any time.
  8. The cost of using the Internet connection is not refundable. Bar-le-Duc and any (auxiliary) person(s) or third party(ies) engaged by it shall not be responsible or liable for any lost, late, misdirected, mis-sent, damaged or undelivered entries or for any entries that are otherwise not received by Bar-le-Duc or not received in time.

THE PRIZES AND WINNERS

  1. A maximum of one (1) prize can be won per activated promotion code. Participants who have activated the promotion code will be able to see if they have won their chosen prize immediately upon registration. After registering the required personal information, the winner will be contacted by phone/email within 14 days to discuss the handling of the prize. This communication will be via Brand Builders.
  2. The confirmation emails containing the code will also specify the period of validity of the prize and how the entrant can collect it. See also below for the validity of the various prizes.
  3. Additional terms and conditions of the promotion may apply to each prize (e.g.) validity, these are listed at the bottom of these terms and conditions of the promotion and also on the promotion website with the selected prize.
  4. During the promotion, all available prizes will be awarded impartially and completely randomly to activated and registered promotion codes.
  5. Bar-le-Duc guarantees that every participant has an equal chance of winning. Any claims based on the odds of winning are excluded in advance.
  6. The announcement of the winners is final. No correspondence will be entered into.
  7. Prizes are non-transferable and cannot be sold, exchanged or paid in cash.
  8. Bar-le-Duc reserves the right to substitute a prize of equal value without prior notice if, in the opinion of Bar-le-Duc, special circumstances make this necessary or desirable.
  9. Promotion codes that have not been activated and registered are invalid and expressly excluded from the awarding of prizes. No prizes will be awarded on the basis of these promotion codes and any claims in this regard will be rejected in advance by Bar-le-Duc.
  10. Winners of the prizes may be asked by Bar-le-Duc to participate in any promotional activities of Bar-le-Duc as far as can reasonably be expected of them, including publicity of the prize-giving event through all media such as radio, television and the Internet. No financial compensation will be paid for participation in promotional activities.

PERSONAL DATA

  1. In connection with the Promotion, each entrant shall ensure that the personal data he/she provides or enters is accurate, up to date and complete. By providing personal data to Bar-le-Duc via the promotion website in order to participate in the promotion, the participant agrees that this personal data may be stored in one or more databases.
  2. Bar-le-Duc will treat the entrant’s personal data confidentially and in accordance with the Data Protection Act. Click here for our privacy statement.
  3. The personal data may be used for the purposes of the promotion and the awarding of the prize. In this context, Bar-le-Duc is entitled to share the personal data with third parties and/or producers. In its relationship with such third parties, Bar-le-Duc will ensure that such third parties also comply with the Personal Data Protection Act.

LIABILITY

  1. Bar-le-Duc and the (auxiliary) persons or third parties engaged by Bar-le-Duc shall not be liable for any damage, costs or charges related to participation in the competition and/or inability to participate in the competition, the awarding or non-awarding of the prizes, the acceptance and receipt of the prizes or their use, except in the event of wilful misconduct or gross negligence.
  2. Bar-le-Duc shall not be liable for (the consequences of) any defects in the prizes provided by its suppliers and other third parties.
  3. Printing, spelling or other similar errors shall not give rise to any additional liability on the part of Bar-le-Duc.
  4. Participants agree that they participate in the promotion at their own risk. Bar-le-Duc cannot be held responsible for any incidents, events or accidents that may occur during the execution of the prize won, and these are therefore at the participant’s own risk.

OTHER

  1. It is not possible to participate in this promotion in any way other than as described in the terms and conditions of the promotion.
  2. Bar-le-Duc reserves the right to amend or terminate these terms and conditions of the promotion at any time for any reason whatsoever, provided that such amendment or termination may not give rise to any claim against Bar-le-Duc. Bar-le-Duc therefore advises participants to check the terms and conditions of the promotion regularly.
